BinShare is a peer-to-peer platform that connects users who have available space in their curbside waste bins with users who need to dispose of household waste. The App facilitates bookings for shared bin space on designated pickup nights.
You must be at least 18 years of age and legally able to enter into binding agreements to use BinShare. By using the App, you represent and warrant that you meet these requirements.
You must create an account to use BinShare. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
BinShare offers the following subscription tiers, billed monthly:
In addition to the subscription fee, a per-booking fee applies for each bin reservation. A portion of each booking fee is paid to the bin owner, with the remainder retained by BinShare as a platform fee. The revenue split varies by the bin owner's subscription tier.
Subscription fees are billed through the Apple App Store or Google Play Store. All pricing is displayed in the App and may change with notice.
Bin listings on BinShare are organised by property (physical address). Each unique address counts as one property. The number of properties you may list, and the number of individual bins per property, is determined by your subscription tier. Exceeding your plan's limits is a violation of these Terms and may result in account suspension.
Paid subscribers who actively list bins and fulfil bookings as hosts may earn monthly host credits that offset their subscription fee. Credits are calculated as follows:
Host credits are applied as a discount against the following month's subscription renewal and have no cash value. Credits cannot be transferred, withdrawn, or redeemed for cash.
When you book bin space through the App, you agree to the following:
BinShare includes community features that allow users to post content, comments, and interact with others. By using these features, you agree to the following rules regarding User-Generated Content (UGC):

Violation of these prohibitions may result in immediate and permanent account termination without refund. You may also be held liable for any costs, fines, or damages resulting from improper disposal.

Commercial subscriptions are intended for businesses and users with commercial waste disposal needs. Commercial users gain access to commercial dumpster listings and unlimited bookings. If you generate waste in a commercial capacity, you are required to subscribe to the Commercial plan. Using a residential plan for commercial waste is a violation of these Terms.
To maintain the integrity of the platform, BinShare actively monitors account usage patterns, booking frequencies, and waste volumes to detect potential abuse. If we detect that a residential account is being used for commercial purposes, or if an account exhibits suspicious activity, we reserve the right to flag the account for review, suspend access, or require an upgrade to the appropriate subscription tier.
Automated activity tracking is used to calculate host credits, acceptance rates, and listing compliance. This data may also be used to detect and prevent gaming of the host credit system.
If you list your bin on BinShare, you agree to:
The App uses your device's location services to show nearby bins. By granting location permissions, you consent to the collection and use of your location data as described in our Privacy Policy. Bin addresses are never displayed publicly and are only shared with users who have a confirmed booking.
All payments are processed through the Apple App Store or Google Play Store. BinShare does not store your payment information. Refund requests for subscriptions must be directed to the respective app store. Booking fees are non-refundable once a booking is confirmed, except in cases where BinShare determines a refund is warranted (e.g., the bin was not placed at the curb).
BinShare is a platform that facilitates connections between bin owners and users. We do not own, operate, or manage any bins. To the maximum extent permitted by law:
Warranty Disclaimer (Apple App Store): In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are BinShare's sole responsibility.
You agree to indemnify and hold harmless BinShare, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the App, your violation of these Terms, or your disposal of prohibited materials.
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Any accrued but unapplied host credits are forfeited upon termination. Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) shall survive.
We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

The following clauses are required by Apple's Minimum Terms of Developer's End-User License Agreement for all apps distributed on the App Store.
1. Acknowledgement: You and BinShare acknowledge that this EULA is concluded between you and BinShare only, and not with Apple. BinShare, not Apple, is solely responsible for the BinShare app and the content thereof. This EULA may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.
2. Scope of License: The license granted to you for the BinShare app is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
3. Maintenance and Support: BinShare is solely responsible for providing maintenance and support services for the app. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the BinShare app.
4. Warranty: BinShare is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are BinShare's sole responsibility.
5. Product Claims: You and BinShare acknowledge that BinShare, not Apple, is responsible for addressing any claims relating to the app or your possession and/or use of the app, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Rights: In the event of any third-party claim that the BinShare app or your possession and use of the app infringes that third party's intellectual property rights, BinShare, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance: You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Terms of Agreement: When using the BinShare app, you must comply with applicable third-party terms of agreement, including your wireless data service agreement and any applicable terms of service for third-party integrations used by the app.
10. Third-Party Beneficiary: You and BinShare acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
